Evolution and Objectives of GST

Unit
  • Historical context: GST emerged as a reform to replace multiple cascading indirect taxes such as excise duty, VAT, service tax, and entry tax, aiming to create a unified national market. India implemented GST on July 1, 2017, after decades of deliberation.
  • Primary objective: Eliminate the cascading effect of taxes by allowing seamless input tax credit across the supply chain, reducing the overall tax burden on goods and services and improving competitiveness.
  • Economic integration: GST promotes a common market by removing inter-state tax barriers, simplifying logistics, and encouraging efficient allocation of resources across state boundaries.
  • Revenue efficiency: A broader tax base with fewer exemptions increases government revenue while reducing tax evasion through better compliance mechanisms like matching of invoices and electronic filing.
  • Transparency and ease of business: GST replaces multiple returns and procedures with a simplified online compliance system, reducing the cost of doing business and enhancing transparency in tax administration.
  • Consumer benefit: The overall tax burden on final consumers is expected to decrease as input tax credits flow through, reducing the hidden taxes embedded in the price of goods and services.
  • International alignment: GST aligns India with over 160 countries that have adopted a value-added tax system, facilitating international trade and attracting foreign investment by providing a predictable tax regime.
  • Challenges in implementation: Transition issues such as input tax credit carry-forward, classification disputes, and technology glitches had to be addressed, leading to continuous refinements and Council meetings.
  • Dual GST structure: India follows a dual model where both central and state governments levy tax simultaneously. CGST is collected by the Centre on intra-state supplies, SGST by the state, and IGST on inter-state supplies, ensuring revenue sharing without overlapping jurisdiction.
  • Rate structure and classification: GST rates are grouped into four main slabs of 5, 12, 18, and 28 percent, with essential items taxed lower or exempt. A cess is applied on luxury and sin goods to compensate states for revenue loss during the transition period.
  • Composition scheme for small taxpayers: Businesses with annual turnover below a threshold can opt for a simplified composition scheme, paying a flat rate on turnover with minimal compliance. This reduces the burden of detailed invoice-level filing for small traders and manufacturers.
  • Anti profiteering provisions: The National Anti Profiteering Authority ensures that businesses pass on the benefit of reduced tax rates or input tax credit to consumers in the form of lower prices. Complaints of profiteering are investigated and can lead to penalties.
Regulatory Requirement

Regulation: Constitutional (101st Amendment) Act, 2016

The amendment created Article 246A empowering both Parliament and State Legislatures to levy GST. It also established the Goods and Services Tax Council as a joint forum for the Union and States to make recommendations on rates, exemptions, and administration.
